Terms and conditions

of de-la-le.com (the “Website”) and the web shop maintained by Trude Ledosquet Sarl, having its registered office at L-7374 Bofferdange, 241, Rte de Luxembourg, Luxembourg. The present General conditions are drafted and available in English language. The use of the Website and the Web shop as well as the sale of goods through the Web shop are subject to the present general conditions of use and sale. By using the Website you expressly agree to be bound by the present general conditions.

Usage of your account

You are responsible for ensuring that your account details (user name and password) are kept confidential, thus ensuring that no other person than you may use these account details for logging onto the Website in your name or purchase items over the Website in your name. You will inform us as soon as possible if you have reason to believe that your user name, password and/or computer have been compromised. You are responsible for the content that is sent by your computer to us. We reserve the right to refuse access to the Website or close your account at our discretion.

Transmissions / Nature of internet

Given the nature of the internet, we cannot guarantee that transmissions will be uninterrupted or error-free, although we will make our best possible efforts to ensure that such interruptions and repair or maintenance work on the Website will be limited to a minimum.

All the images and texts, as well as all brands presented on the Website are the exclusive property of Trude Ledosquet Sarl or our affiliates or content suppliers and are protected by Luxembourg and international copyright laws. “DeLaLedosquet” and the DeLaLe logo are registered trademarks, and may not be used in any manner by you or other third parties.

Images of products on the Website are for illustrative purposes only; actual products may slightly differ from such images.

You are only allowed to personally access and use the Website, but may not download it partially or completely without our prior consent. You may not use the Website for any commercial use. You may not frame the Website in order to use your own domain name, trademark, logo or any other information in connection with the Website.

You may create a hyperlink to the Website, as long as the referring website does not paint the Website in a false or misleading way. This limited authorization is revocable at any time. You are not allowed to use the Website in any way that could cause its access or that of other websites to be interrupted.

Formation of the contract

The advertising of products on the Site constitutes an “invitation to trade “.Your order to us represents an “offer to purchase goods” from the Web shop. This offer will only become a binding contract after we have confirmed your offer via a confirmation e-mail. Only products referred to in the confirmation email are to be considered as being part of the contract concluded between you and us.

Returns

If a purchased item is damaged, ineffective or incorrect, you may return it to us in its original condition within 14 days of the date you received the item, with any seals and/or shrink-wrap intact, and labels attached. We will then issue a full refund for the price you paid for the item as well as the return costs. Returns shall be sent to the following address:

Reduced items are excluded from returns.

Pricing / Availability

The products will be sold for the price indicated on the Website. In addition to the price of the products, you will have to pay a delivery charge, which will be calculated as provided for by our shipping conditions. The prices on the Website include any value added or sales taxes (where applicable). Prices for products change at any time, but changes will not affect orders which have come into force.

There will be no guarantee as to the availability of the products. There is also no guarantee for the dispatching times indicated.

You will bear all risks in relation to the products from the moment of delivery onwards. However, ownership of the products will only pass to you only after we receive full payment of all sums due in respect of the products (including delivery charges).

If a product becomes unavailable during the processing of your order, we will inform you by email and cancel the order and refund you if payment has already been effected.

International orders

We guarantee delivery to all countries within Europe. We do not guarantee delivery to other countries.

Liability

We may not be liable for any direct or consequential loss that was not reasonably foreseeable to any of the parties at the time of the conclusion of the contract. We will not be liable or responsible for any failure to perform, or delay in performance of our obligations caused by events which are outside our reasonable control.

Warranties

You warrant to us that: you have full authority, power and capacity to enter into purchases on the Website and that all necessary actions have been taken to enable you to lawfully enter into these purchases; you are legally capable of entering into binding contracts; you are at least 18 years old; the information provided in your order is accurate; and you will be able to accept delivery of the products as contemplated in the present general conditions.

Communication

By using the Website and the Web shop, you expressly agree that all communications between you and us may take place electronically, and you agree that both parties will be bound by electronic communications and that these are considered to have the same legal value as agreements in writing.

Interest rates

We intend to make use of article 12 of the Luxembourg law of 18 April 2004 concerning late payment and interest rates. The amounts owed as per our invoices will produce interest at the legal rate 3 months after the reception of the purchased goods.

Changes

We reserve the right to modify the present conditions of use and sale at any moment, as well as to make changes to the Website and our various policies.

The applicable conditions of use and sale will be those which were in force at the moment the sale contract was concluded. If any condition of the present general conditions is ruled invalid, this will not affect the rest of the present general conditions, which will remain entirely in effect.

Privacy

The information you provide us with during your shopping and ordering of products, is used to deliver the ordered products, process the payments, communicate with you about your orders, our products and our promotional offers, update our records and, in a general fashion, maintain your account with the Website and the Web shop. We also use this information with the goal of improving our platform and your shopping experience by being able to present you with products which you may find interesting. This information may also be used to detect and combat fraud or abuses.

Applicable law and jurisdiction

These conditions are governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg, and the application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded. You agree to submit to the jurisdiction of the courts of the district of Luxembourg City. If any provision of the present general conditions is held invalid or unenforceable , the remaining provisions of the present general conditions shall remain in full force and effect, and such invalid or unenforceable provisions or portion thereof shall be deemed omitted.
